These Terms of Service (“Terms”) govern your access to and use of the courier, delivery, and logistics services provided by Swyft Courier (“Swyft”, “we”, “us”, or “our”), including our website, online booking tools, and any related services (collectively, the “Services”). By booking a shipment, creating an account, or otherwise using the Services, you (“Customer”, “you”) agree to be bound by these Terms.
Last updated: June 16, 2026. We may update these Terms from time to time; the version in effect when you book a shipment applies to that shipment.
1. Services
Swyft provides same-day, next-day, scheduled, and freight courier services within our published service area in the Lower Mainland of British Columbia and surrounding regions. Service availability, cut-off times, and delivery windows are estimates and may vary based on volume, weather, traffic, and other conditions outside our reasonable control. We do not guarantee a specific delivery time unless a guaranteed service level has been purchased in writing.
2. Booking and Account
You are responsible for providing accurate and complete shipment information, including pickup and delivery addresses, recipient details, package contents, weight, and dimensions. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. Swyft may refuse, cancel, or hold any shipment at its discretion where information is incomplete, inaccurate, or where the shipment violates these Terms.
3. Pricing and Payment
Charges are calculated based on the service level, distance, weight, dimensions, and any applicable surcharges (including but not limited to fuel, wait time, redelivery, after-hours, and special handling). Quoted prices are estimates until the shipment is tendered and verified. Unless otherwise agreed in writing, invoices are due upon receipt. Late payments may be subject to interest and the suspension of Services. All prices are in Canadian dollars and exclusive of applicable taxes.
4. Pickup and Delivery
You must ensure that packages are properly packed, labelled, and ready at the scheduled pickup time. Where a recipient is unavailable, Swyft may, at its discretion, leave the shipment in a safe location, attempt redelivery (which may incur a fee), or return the shipment to the sender. Proof of delivery may be provided in the form of a signature, photo, or electronic confirmation.
5. Prohibited and Restricted Items
You may not ship items that are illegal, hazardous, perishable without suitable packaging, or otherwise restricted by law or by our policies, including but not limited to: dangerous goods, firearms and ammunition, illegal substances, live animals, human remains, cash and negotiable instruments, and items requiring special licensing. Swyft may refuse or dispose of any prohibited shipment, and you remain responsible for any resulting costs, fines, or liabilities.
6. Liability and Claims
Except as required by applicable law, Swyft’s liability for loss of or damage to a shipment is limited to the declared value of the shipment, unless additional coverage has been purchased in advance. Swyft is not liable for indirect, incidental, consequential, or special damages, including lost profits or business interruption. Claims for loss or damage must be submitted in writing within seven (7) days of the delivery date (or expected delivery date), accompanied by supporting documentation. We are not liable for delays or failures caused by events beyond our reasonable control.
7. Cancellations and Refunds
Bookings may be cancelled before a driver has been dispatched without charge. Once a driver has been dispatched or pickup has occurred, cancellation fees may apply. Refunds for service failures are assessed on a case-by-case basis and, where granted, are limited to the amount paid for the affected shipment.
8. Indemnification
You agree to indemnify and hold harmless Swyft, its officers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your shipment of prohibited items, or your violation of any applicable law or third-party rights.
9. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Services you consent to the collection and use of information as described there.
10. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in British Columbia for any dispute arising out of or relating to these Terms or the Services.
